Money Back Guarantee

1) Money Back Guarantee:

1.1) All wine and alcohol products on Black Market carry a full money back guarantee on unopened bottles bought from either blackmarket.co.nz or the actual supplier of the Product, as appropriate.

1.2) If you believe the product to be faulty or defective, simply contact Black Market at [email protected] and we will inform the associated winery/distributor who will contact you directly to arrange the return of the remaining unopened bottles of the Product and the refund of the full purchase price.

1.3) The money back guarantee on unopened bottles only applies to Products you believe to be faulty or defective and where you have contacted Black Market within 30 days of the purchase date and within two days of the day on which the Product was opened.

1.4) Products found to be faulty or defective after 30 days of following the purchase date will be replaced by Black Market or the supplier, as appropriate, with a bottle of the same Product (subject to availability). You must retain the sample of the faulty or defective Product for the supplier’s assessment in order to receive a replacement Product.

1.5) Please note: our money-back guarantee does not include ‘taste preference' returns. If the Product is not to your taste preference, please contact us at [email protected] to discuss our returns policy. A collection fee will be charged.

2) Exclusions:

2.1) This money back guarantee does not apply to any Product that is:

  1. priced at over $100 per bottle; or
  2. not sold in multiples of 6 (regardless of the number of bottles purchased).
3) Storage:

3.1) All products purchased through Black Market site should be stored in accordance with usual good practice (having regard to temperature, light, humidity).

3.2) Failure on your part to store wine correctly may cause the Product to deteriorate and the money back guarantee or the remedies otherwise available under the Consumer Guarantees Act 1993 may not be available as a result.

4) Consumer Guarantees Act:

4.1) This money back guarantee is not an attempt by any person to contract out of the Consumer Guarantees Act. Black Market and its suppliers are bound by the provisions of that Act except where wine is purchased for business purposes.

4.2) Customers still have recourse to the remedies contained in the Consumer Guarantees Act 1993. If you wish to make a complaint under that Act, please contact Black Market at [email protected]

5) Business Purchases:

5.1) If you are purchasing Products for the purpose of a business (i.e. you are purchasing in trade) you agree that these terms constitute the entire agreement between you and Black Market and the Fair Trading Act 1986 does not apply.
