Wines - Money Back Guarantee:
All wine, other than Excluded Wine as described below, on blackmarket.co.nz carries a full money back guarantee by the associated winery/distributor.
On opening the first bottle from any case if you are not completely satisfied with the product, simply contact blackmarket.co.nz at returns@blackmarket.co.nz and we will advise the associated winery/distributor who will then contact you directly to arrange to pick up the remaining unopened bottles.
The full purchase price will then be refunded.
The money back guarantee only applies where you have notified us that you are not satisfied with the product in accordance with these terms within 30 days of the purchase date and within 2 days from the day on which the first bottle of the wine is opened.
Excluded Wine:
The Money Back Guarantee offered in respect of wine sold on blackmarket.co.nz does not apply to any wines that (a) are listed as Connoisseur Wines; or (b) have a single bottle value of more than $250; or (c) are not sold in multiples of 6; regardless of the number of bottles purchased.
However, you may in respect of Excluded Wine have recourse to the remedies contained in the Consumer Guarantees Act 1993. In cases where you wish to make a complaint under the Consumer Guarantees Act 1993 please contact us at returns@blackmarket.co.nz and we will forward your message to the associated winery or distributor from whom you purchased the wine.
Note: this clause is not an attempt by the associated winery/distributor to contract out of the Consumer Guarantees Act. The associated winery/distributor is bound by the provisions of that Act except where the product is purchased for business purposes.
Wines - Corked Wines:
Corked wines will be refunded by the associated winery with a replacement bottle of the same wine.
You must retain the sample / samples of the corked wine for the wineries assessment to receive a replacement bottle / bottles.
This must be done within 2 days from the day on which the wine is opened.
Storage:
All wine purchased through the blackmarket.co.nz site should be stored as directed by the associated winery/distributor, or if there is no direction, otherwise in accordance with usual good practice (having regard to temperature, light, humidity). Failure on your part to store wine correctly may cause the wine to become defective and in such cases the remedies otherwise available under the money back guarantee or the Consumer Guarantees Act 1993 may not be available.
